APUO Reaction to a New Employer Policy Regarding Office AllocationThe employer has provided APUO with a new set of guidelines regarding the allocation of office space on campus, especially during periods of leave or during periods of appointment to administrative positions. The employer claims that with the hiring of new professors, space on campus is getting extremely tight. It wishes to have the new guidelines in place by the beginning of July when newly hired professors normally take up their appointments, and it has asked APUO for its reaction. While the APUO can appreciate the employer’s desire to make efficient use of available office space, it has a number of important concerns regarding the details of the new guidelines and the manner in which they are being drawn up and implemented. Le professeur doit préciser, avant son départ en congé, le genre d’accès à un bureau et à une superficie de recherche dont il aura besoin, compte tenu de l’activité prévue sur le campus pendant cette période et le doyen lui donne l’accès approprié pour accomplir cette activité sur le campus. Les professeurs qui ne sont pas obligés de libérer la superficie pendant leur absence du campus prennent des dispositions avec le doyen, peu importe la durée du congé, pour faciliter l’accès à leur bureau.
APUO Concerns about the New Guidelines APUO has raised a number of concerns with the employer, in particular to ensure that any rights under sections 5.1.1 and 5.1.2 of the collective agreement (and related practices) are respected. A quick survey of various units shows that there are currently varying practices regarding the allocation of space. The APUO feels it is of utmost importance that local conditions be taken into account in the implementation of any space allocation policy. APUO is suggesting to the employer that a very general set of university-wide guidelines for space allocation be established and that these guidelines be formalized and implemented in each faculty through faculty-level collegial committees. For example, a faculty executive could follow a general set of University-wide guidelines to draft a local policy taking into account local needs, with the policy then approved by faculty council. Moreover, the new guidelines raise some general issues of concern. For example, the guidelines speak of a "maximum allocation” of one private office to regular faculty. This could imply that a member may not be allocated his or her own office at all, which the APUO would view as a violation of existing rights if applied in that manner. Even where it has been the practice in the past and where it is appropriate to provide in the future for a release/sharing of office space for longer leaves, the following problems with the guidelines have been raised with the employer. · The criterion of "more than 4 months and for more than 50% of the time” is unreasonable and potentially confusing. · The expected office access for leaves of "whatever period of time” (i.e., shorter than four months) appears to overreach and raises concerns with respect to existing rights. · Under the section dealing with "relocation and storage”, there is no attempt to address the responsibility for belongings or material left in the office. It is also not clear how the return of belongings to the office will be handled. Finally, if the request/decision respecting the office is made following a professor’s departure from campus, professors might well not be able to comply with the requirement to be present for the move in order to ensure University liability. · There is a substantial concern regarding information stored on computers in shared offices, as well as documents that may be left in such offices. Questions of confidentiality are obviously of concern with regard to such equipment and documents. Above all, the APUO feels that the employer is rushing to implement this policy without any real consultation. This runs counter to the interest-based bargaining approach taken in negotiating the current collective agreement. Since the parties have committed themselves to using interest-based bargaining for the next round of negotiations, it seems reasonable to make use of this process on an ongoing basis. In an attempt to avoid a dispute over this issue, APUO has asked that the parties review these concerns before any guidelines are distributed and implemented.
